This legislation was enacted in July 2008.
The Act enables Anguilla to offer the civil law private foundation concept as an alternative to the existing common law trust available in Anguilla, while providing a high level of protection in terms of anti-forced heirship rules and rules overriding foreign laws and judgments. It also has the unique advantage, compared with similar legislation in other jurisdictions, of permitting enforcement under an almost infinite variety of procedural and/or geographic regimes.
These strong protections will keep Anguilla at the forefront in this field. We consider that the proposed Anguilla legislation is an improvement over previous foundations legislation enacted in other jurisdictions and that it will be warmly welcomed in the international estate planning community.
